Holiday Complaints | Searching for Legal Experts
Should you require free legal advice, then we have our own panel of specialist legal experts in the field of International Travel Litigation.
All of them are experts in dealing with holiday complaints involving contractual and personal injury holiday claims.
There are very few law firms who are experienced in the field of
Class/Group Actions
A Class/Group Action allows claims to be aggregated into one lawsuit for discovery, trial and/or settlement.
In other words, it is where several people who have suffered the same or similar experience, can pursue together an action for compensation, sharing the evidence, the costs, the risks and the witnesses.
It then makes it easier to challenge large corporate defendants.
Legal Costs
Do not decide against making a claim on the grounds of costs without seeking free legal advice first.
In most successful claims the majority of your legal costs are likely to be recovered from the party at fault.
You may be able to receive assistance through any of the following:
- Conditional fees (’No Win, No Fee’)
- Legal expenses insurance (You may be covered on your Household Contents Insurance)
Your solicitor will explain these to you in more detail.
Compensation - How Much Will I Get?
If your claim is successful, you will be awarded compensation. The amount of compensation will depend on the circumstances of the case. In holiday claims against tour operators, damages may be recovered for all or some of the following (please note this list is only intended to be a guide to what you can claim, you should always check with a solicitor who should be able to guide you further):
- Diminution in holiday value: In other words, a sum to compensate you for the holiday you paid for but did not get. This award is generally capped at 100% of the holiday cost.
- Loss of enjoyment of holiday/mental distress and anxiety: This can be assessed by reference to a daily rate which currently may be up to £150.00 per day or more for each day your holiday was affected, or a percentage of the holiday cost.
- Pain, suffering and loss of amenity: You will be awarded damages assessed by reference to the duration and severity of any illness or injury and long term consequences.
- Special damages and future losses: This includes any loss of earnings, travelling expenses, damaged or lost personal possessions, and any private medical or therapeutic expenses.
If you encounter difficulties in pursuing your claim, and you would like to be referred for initial free legal advices, then please contact HolidayTravelWatch immediately.
Please note: reference to awards are done so from legal text research and by reference to legal cases. There are many publications available from most major bookstores, or from any law library, which will illustrate the various heads of damage. By its very nature, you should note that each case will depend on its merits. You should fully research any head of damage before making a claim - if you are unsure, always check with a legal advisor or contact us for further assistance. Please note we do not offer a research service to law students.
